On March 1, 2017 at approximately 1625 hours, Deputy Malone was dispatched to 325 Hempstead 227 North in reference to a suspicious person.
Upon arrival he made contact with Tina Pennington. While talking to Tina he smelt the odor of intoxicants coming from her breath. Deputy Malone asked Tina what she had been drinking and how much. She stated that she has been drinking "Hot Damn", and that she is "very intoxicated". Deputy Malone asked her why she was trespassing on someone else's property, and she stated that she was trying to get home.
Deputy Malone made contact with Hector and Diana Aguirre. Diana stated that when she arrived home from work Tina tried to get in her vehicle, but she stopped her from doing so. Diana stated that Tina told them she wanted to die, and was hitting herself in the head with the "Hot Damn" bottles that she had. Diana stated that they were worried because she did not want Tina to hurt herself.
Deputy Malone placed Tina under arrest for Public Intoxication and Criminal Trespassing. When he placed Tina into the back of my patrol unit, she started banging her head against the window and the cage in his patrol unit. Deputy Malone opened the door to his unit and tried to calm Tina down, and was successful.
While in route to the Jail Tina began banging her head on the window and cage of the patrol unit again. Deputy Malone advised Dispatch to have EMS meet him at the Sally port. Also while in route to the Jail Tina tried to open the door to his patrol unit several times, and broke the door handle on the inside of the back driver's side door.
As Malone arrived at the Jail Tina began banging her head again on the window of my patrol unit. Detention Sergeant Jimmy Wise and Malone tried to extract her from the vehicle. Tina hooked her leg under the seat, to resist. Officers were able to extract her from the vehicle and put her in the restrain chair. EMS tried to treat Tina and she refused medical treatment. Tina was taken into the jail and booking using proper booking procedures.
